These general terms and conditions of sale, hereinafter referred to as «GTC», govern sales made on the website Tenzin Tsémé by Véronique Alber Latour, sole trader trading under the business name Weebicom.

They apply to sales of original works and custom commissions made directly with Tenzin Tsémé. Fine art prints ordered on the Art Majeur platform are subject to special provisions detailed below.

1. Seller identity

These general terms and conditions of sale, hereinafter referred to as «GTC», govern sales made on the website Tenzin Tsémé par Véronique Alber Latour EI, exerçant sous le nom commercial Weebicom et développant son activité artistique sous le nom Tenzin Tsémé.

Elles s’appliquent aux ventes d’œuvres originales et aux commandes personnalisées réalisées directement auprès de Tenzin Tsémé. Les tirages d’art commandés sur la plateforme Artmajeur sont soumis aux conditions de cette plateforme, conformément aux précisions figurant ci-dessous.

Dans les présentes CGV, les termes « Tenzin Tsémé », « le vendeur » ou « nous » désignent Véronique Alber Latour EI, exerçant sous le nom commercial Weebicom et exploitant le site sous son nom d’artiste Tenzin Tsémé.

2. Purpose and scope

The purpose of these Terms and Conditions is to set out the rights and obligations of the seller and the customer in relation to orders placed on the Tenzin Tsémé website.

Placing an order implies that the customer has read and accepted these Terms and Conditions prior to payment.

The applicable Terms and Conditions are those in force on the date of the order. They may be amended at a later date to take account, in particular, of changes to the business, delivery methods, the services offered or the relevant regulations.

3. Works and products on offer

The website may feature several categories of designs.

Original works

The original works are handmade by Tenzin Tsémé. Unless otherwise stated on the product page, an original is a one-off item. The entry for each work specifies, in particular, its format, technique, medium and, where relevant, the main characteristics of its creation. The handcrafted nature of a work necessarily involves slight irregularities in the paper, the line, the ink or the colour. These characteristics form part of the original work and do not in themselves constitute a defect.

Custom illustrations

Tenzin Tsémé also creates bespoke illustrations based on material provided by the client, including photographs of houses, streets, villages, towns or other locations. The details of the commission are agreed with the client prior to payment: format, subject matter, reference photographs, specific requests, price and estimated completion time. These creations are produced specifically for the client and constitute personalised items.

Art prints

Some works may be available as prints and reproductions via the platform Major Art. When a customer leaves the Tenzin Tsémé website to place an order for a print directly on Art Majeur, the order is finalised on the Art Majeur platform. Production, invoicing, delivery and customer service relating to this order are then handled in accordance with the terms and conditions set out by Art Majeur. These Terms and Conditions of Sale therefore do not apply to orders for prints placed directly on Art Majeur.

4. Presentation of the works

Tenzin Tsémé takes the utmost care in the presentation of the works and in ensuring the accuracy of the photographs and digital scans used on the website. However, the colours displayed may vary slightly depending on the visitor’s screen, its settings, brightness or the equipment used. Where a work has significant characteristics relating to the paper, materials or technique used, these are specified as far as possible in its description. For original works, the photographs are intended to show the actual work being offered for sale.

5. Price

Les prix sont indiqués en euros. Le prix applicable est celui affiché sur le site au moment de la validation de la commande.

Tenzin Tsémé bénéficie du régime de franchise en base de TVA. La TVA n’est donc pas facturée tant que les conditions permettant de bénéficier de ce régime sont remplies.

La livraison suivie est offerte vers la France métropolitaine, Monaco et Andorre Son coût est intégré au prix de l’œuvre.

Un supplément de livraison est appliqué pour les autres destinations :

• 7,50 € vers les pays de l’Union européenne, la Suisse, le Liechtenstein, Saint-Marin et le Vatican ;
• 27,50 € vers les autres destinations internationales proposées lors de la commande.

Le montant total à payer, comprenant le prix de l’œuvre et l’éventuel supplément de livraison, est indiqué au client avant la validation définitive de la commande.

6. Placing an order

The customer selects the artwork they wish to buy and follows the various steps in the ordering process.

Before making payment, it is his responsibility to check, in particular:

• the work or product ordered; ;
• its price; ;
• any options selected; ;
• the billing address; ;
• the delivery address or location; ;
• the delivery method; ;
• transport costs; ;
• the total amount of the order.

The customer must also read and accept these Terms and Conditions of Sale. Final confirmation of the order constitutes an obligation to pay. An order confirmation is sent to the customer electronically.

Tenzin Tsémé reserves the right to refuse or cancel an order in the event of an obvious pricing error, a technical issue, exceptional unavailability of the artwork, or a previous payment dispute with the customer. In the event of the cancellation of an order that has already been paid for, for a reason attributable to the seller, the sums paid will be refunded.

7. Availability of originals

As an original work is generally unique, it can only be sold once. Every precaution is taken to keep the availability shown on the website up to date. However, a simultaneous sale or synchronisation error may exceptionally occur.

If a commissioned work is ultimately no longer available, the customer is informed and the amount paid for this work is fully refunded. The seller is not required to produce a new work identical to an original that has become unavailable.

8. Payment

Les commandes effectuées directement sur le site sont payables intégralement au moment de leur validation.

Les paiements sont traités de manière sécurisée par Stripe. Selon le pays du client, son appareil et les moyens de paiement disponibles, le règlement peut notamment être effectué par :

• carte bancaire ;
• Bancontact ;
• Apple Pay ;
• Google Pay ;
• Link par Stripe.

Tenzin Tsémé n’a pas accès au numéro complet de la carte bancaire ni aux autres coordonnées bancaires complètes du client.

La commande n’est considérée comme définitivement enregistrée qu’après confirmation du paiement. En cas de refus ou d’échec du paiement, la commande n’est pas validée et l’œuvre reste disponible à la vente.

Aucune œuvre n’est expédiée et aucune commande personnalisée n’est commencée avant confirmation du paiement intégral, sauf accord écrit contraire.

9. Custom commands

Before making any payment for a bespoke order, the customer must provide the information required to assess their request. Tenzin Tsémé will, in particular, check that the photographs and information supplied are sufficient to produce the requested illustration.

Production does not begin until:

1. confirmation of the order’s feasibility; ;
2. agreement on the format and main characteristics; ;
3. price communication ;
4. information on the estimated completion time; ;
5. full payment of the order.

The customer is responsible for the documents and photographs they provide and guarantees that they hold the rights or authorisations required to use them as references for their order. The creation of a bespoke illustration constitutes an artistic interpretation of the requested subject and is not necessarily an exact photographic reproduction.

Any request that substantially alters the characteristics initially agreed upon may require an extension of the deadline or an additional charge. In such cases, no changes subject to a charge will be made without the client’s prior consent. Any arrangements for interim approval or corrections will be explained to the client prior to production, where such arrangements are required for the order in question.

10. An introduction to custom commands

A personalised illustration remains protected by Tenzin Tsémé’s copyright. However, given the personal nature that a house, a place or a family memory may have, Tenzin Tsémé will not publish any identifiable personalised commission on her website, portfolio, social media or other communication channels. only with the client’s prior consent. This publication agreement does not entail any transfer of copyright to the client, nor any transfer of the client’s rights in any photographs that may be provided.

11. Delivery areas and methods

Les destinations effectivement disponibles sont celles proposées au client lors de la validation de sa commande.

Les conditions suivantes sont appliquées :

• France métropolitaine, Monaco et Andorre : livraison suivie offerte ;
• Union européenne, Suisse, Liechtenstein, Saint-Marin et Vatican : livraison suivie avec un supplément de 7,50 € ;
• autres destinations internationales proposées lors de la commande : livraison suivie avec un supplément de 27,50 €.

Les œuvres sont expédiées à l’adresse indiquée par le client. Le transporteur peut varier selon la destination, le format de l’œuvre et les conditions d’acheminement disponibles. Les informations de suivi sont communiquées au client lorsqu’elles sont fournies par le transporteur.

Le client doit fournir une adresse et des informations de livraison exactes et complètes.

En cas de retour du colis à l’expéditeur en raison d’une adresse erronée ou incomplète fournie par le client, ou d’un colis non retiré dans le délai fixé par le transporteur, une nouvelle expédition peut être proposée. Les nouveaux frais d’expédition peuvent alors être facturés au client lorsqu’aucune faute du vendeur ou du transporteur n’est à l’origine du retour.

12. Dispatch and delivery times

For an original work that is already available, dispatch will take place, barring force majeure or other impediment, within a maximum of five working days from the date of payment confirmation.

This timeframe refers to the time taken to prepare and dispatch the order. It does not include the carrier’s delivery time.

For bespoke orders, the production time is communicated to the customer before payment. Once the artwork is complete and ready for dispatch, it is handed over to the carrier within a maximum of five working days. Delivery times vary depending on the carrier, the destination and the chosen delivery method.

13. Packaging and transport

The artworks are carefully packaged to minimise the risks associated with transport. The seller remains responsible for ensuring that the delivery is carried out correctly in accordance with the conditions laid down in the relevant consumer legislation. Upon receipt, the customer is asked to check the condition of the packaging and the artwork.

If a work arrives damaged, the customer is asked to contact Tenzin Tsémé as soon as possible at tenzin.tseme@gmail.com, including, where possible, photographs of the parcel, the packaging and the artwork. Reporting the matter promptly helps to speed up the process with the carrier, but does not deprive the consumer of their legal rights and guarantees.

14. Right of withdrawal for non-personalised items

When purchasing an original, non-personalised work online, the consumer has a statutory period of quatorze jours à compter de la réception du bien pour exercer son droit de rétractation, sans avoir à justifier sa décision.

Le client peut exercer ce droit :

• au moyen de la fonctionnalité « Exercer mon droit de rétractation », accessible depuis le pied de page du site ;
• en adressant une déclaration claire par courrier électronique à tseme@tenzin-tseme.fr ;
• en utilisant le formulaire type figurant à la fin des présentes CGV.

La déclaration doit être transmise avant l’expiration du délai de quatorze jours. Lorsqu’elle est envoyée au moyen de la fonctionnalité en ligne, un accusé de réception indiquant le contenu, la date et l’heure de la demande est adressé au client par courrier électronique.

Après avoir communiqué sa décision de se rétracter, le client doit renvoyer l’œuvre au plus tard dans les quatorze jours suivants à l’adresse suivante :

15. Return conditions following withdrawal

The direct costs of returning a work of art subject to cancellation shall be borne by the customer.

Given the nature and potential value of the original works, the client must use suitable packaging to adequately protect the work during transit. The use of the original packaging is recommended where it can be reused safely.

A tracked shipment is strongly advised. For high-value works, a delivery method with appropriate insurance is also recommended. The customer may be held liable for any depreciation of the artwork resulting from handling beyond what is necessary to establish its nature and characteristics.

Return costs associated with a simple change of mind must not be confused with costs incurred due to a defective or non-conforming product, which fall under statutory warranties.

16. Refund after cancellation

Where a right of withdrawal is validly exercised, Tenzin Tsémé shall refund the sums due to the customer in accordance with the applicable legal provisions.

The refund includes, in particular, the price of the item and, where they have been paid by the customer, the costs corresponding to the standard delivery method proposed at the time of the order. When the customer has voluntarily chosen a more expensive delivery method than the proposed standard method, the corresponding additional cost does not have to be refunded.

Reimbursement may be deferred until the goods are recovered or until the customer has provided proof of shipment, whichever occurs first. Unless impossible or otherwise agreed, the refund shall be made using the same payment method as that used for the order.

17. No right of cancellation for personalised orders

In accordance with the regulations applicable to goods made to the consumer’s specifications or clearly personalised, The right of withdrawal does not apply to illustrations commissioned by a client.

This exclusion applies in particular to a work created using:

• photographs provided by the client; ;
• a house or building of his choosing; ;
• from a specific place; ;
• any specific requirements requested for his order; ;
• or any other specification that makes the work distinctly personalised.

The customer is informed of this personalised nature before payment.

This exclusion of the right of withdrawal does not, of course, deprive the customer of the statutory guarantees applicable in the event of a defect or non-conformity of the work with what had been agreed.

Les biens vendus par Tenzin Tsémé bénéficient des garanties légales applicables aux ventes conclues entre un professionnel et un consommateur, notamment de la garantie légale de conformité et de la garantie des vices cachés.

La garantie légale de conformité peut être mise en œuvre pendant une durée de deux ans à compter de la délivrance du bien lorsqu’un défaut de conformité apparaît.

Le consommateur bénéficie également de la garantie légale des vices cachés dans les conditions prévues aux articles 1641 à 1649 du Code civil.

These guarantees apply regardless of whether or not a right of withdrawal exists.

19. Intellectual property and copyright

Intellectual property and copyright

All works exhibited and sold by Tenzin Tsémé are protected by copyright.

The purchase of an original relates exclusively to the physical copy of the work provided to the client. It does not entail any transfer of copyright, reproduction rights or exploitation rights attached to the work.

Unless Tenzin Tsémé has given prior written authorisation, the purchaser may not, in particular:

• to reproduce the work, in whole or in part; ;
• to make, or arrange for the making of, copies, printouts or prints; ;
• use an image of the work for commercial, advertising or promotional purposes; ;
• sell or distribute physical or digital reproductions; ;
• to modify the work in order to exploit a new version of it; ;
• to use all or part of the work on products, in publications or in commercial content; ;
• to transfer or grant rights to exploit the work to a third party.

Copyright remains with Tenzin Tsémé, unless specifically assigned under a separate written agreement.

The purchaser may, of course, keep, display and frame the original work purchased for their own personal use.

The photographs, scans, texts, illustrations and other content on the Tenzin Tsémé website are also protected and may not be reproduced or used without prior authorisation. The website’s graphic and visual elements and content are also protected. Their presence online does not constitute authorisation for reproduction or use.

The purchase of an art print via Art Majeur does not entail any assignment of copyright attached to the reproduced work. Any image usage licences offered separately on Art Majeur are governed exclusively by the conditions and scope of the licence acquired on this platform.

20. Prints ordered via Art Majeur

When the Tenzin Tsémé website includes a link to purchase a print via Artmajeur, the visitor is redirected to this platform to finalise their order.

Production, invoicing, payment collection, shipping and the terms and conditions applicable to this print are then managed in accordance with the terms of the Art Majeur platform. Requests relating to an order placed and paid for on Art Majeur must therefore be handled in accordance with the procedures laid down by this platform. Tenzin Tsémé remains the holder of the copyright attached to the reproduced work and receives, where applicable, the remuneration provided for by their agreement with Art Majeur.

Personal data

Personal data provided when placing an order is used to the extent necessary for order processing, payment, delivery, invoicing and customer relationship management.

Information regarding the collection, use and storage of personal data is detailed in the Privacy Policy from the site.

Payment and delivery service providers may receive the data strictly necessary for the performance of their duties.

22. Liability

Tenzin Tsémé undertakes to exercise reasonable care in the preparation and processing of orders. However, the seller cannot be held liable for damage resulting from misuse of the item, deterioration occurring after delivery, or an event not attributable to the seller. No provision of these terms and conditions of sale may have the effect of depriving the consumer of any mandatory right or guarantee provided by law.

23. Force majeure

The performance of the seller's obligations may be suspended in the event of an occurrence exhibiting the characteristics of force majeure within the meaning of French law. The customer will be informed as soon as possible when such an event causes a significant delay or temporarily prevents the fulfilment of the order.

For any questions or complaints regarding an order placed directly with Tenzin Tsémé, the customer may contact:

The request should ideally mention the customer's name, the order number or reference, and information making it possible to understand the difficulty encountered. Tenzin Tsémé favours an amicable resolution of any disputes.

25. Consumer mediation

After submitting a written complaint to Tenzin Tsémé and in the absence of a satisfactory amicable solution, the consumer may use the consumer mediator to whom Weebicom reports free of charge, under the conditions provided for by regulations.

26. Applicable law and disputes

These Terms and Conditions are governed by French law, without prejudice to any mandatory consumer protection provisions that may apply to the customer by virtue of their place of residence. In the event of any dispute, the customer is invited to contact Tenzin Tsémé with a view to seeking an amicable solution as a matter of priority. If no agreement can be reached, and following any recourse to mediation, the consumer retains the right to bring the matter before the competent court in accordance with the applicable legal provisions.

27. Acceptance of the Terms and Conditions

The customer confirms that they have been able to view these Terms and Conditions of Sale before confirming their order. Confirmation of the order and payment thereof constitute acceptance of the terms and conditions applicable to the sale. A copy of, or permanent access to, the contractual information is provided to the customer as part of their order confirmation.
